6. Right of Withdrawal
A consumer has the right to withdraw from a distance contract without giving a reason within 14 days.
When purchasing goods, the 14-day withdrawal period begins on the day on which the buyer, or a third party designated by the buyer other than the carrier, physically receives the goods.
To exercise the right of withdrawal, the buyer must send an unambiguous withdrawal statement by email to:
The withdrawal statement may be submitted in free form but must include at least:
- buyer’s name;
- contact details;
- order number;
- invoice number;
- name of the product being returned.
After submitting the withdrawal statement, the goods must be returned to Abrasivikeskus Eesti OÜ at:
Artelli tn 8a, Tallinn 10621, Estonia
The buyer must return the goods no later than 14 days after submitting the withdrawal statement.
The buyer may inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning in the same manner as would be permitted in a regular physical store.
If the buyer has used the goods beyond what is necessary to establish their nature, characteristics and functioning, the buyer shall be liable for any decrease in the value of the goods to the extent provided by law.
Where possible, the goods should be returned in their original packaging and complete. The absence of the original packaging does not in itself prevent the exercise of the right of withdrawal, but the buyer shall be liable for any decrease in the value of the goods in cases provided by law.
7. Return Costs and Refunds
When exercising the 14-day right of withdrawal, the buyer generally bears the direct costs of returning the goods, unless otherwise provided by law or otherwise stated by the online store.
In the event of withdrawal from the contract, the online store shall refund the buyer all payments received under the contract, including the amount paid for the goods and the original delivery fee.
If the buyer initially selected a more expensive delivery method than the least expensive standard delivery method offered by the online store, the online store is not required to refund the difference between the more expensive delivery method and the least expensive standard delivery method.
The online store shall issue the refund without undue delay and no later than 14 days after receiving the withdrawal statement.
The online store may postpone the refund until the returned goods have been received or until the buyer has provided evidence that the goods have been sent back, whichever occurs first.
The refund will generally be made using the same payment method used for the original transaction, unless otherwise agreed with the buyer.
8. Exceptions to the Right of Withdrawal
The 14-day right of withdrawal may not apply in cases provided by law. For example, the right of withdrawal does not apply to goods manufactured according to the consumer’s personal needs or specifications.
If the right of withdrawal does not apply to a particular product, the buyer will be informed before the contract is concluded.
9. Defective Goods or Goods Not Conforming to the Contract
Abrasivikeskus Eesti OÜ is responsible for goods sold to consumers that do not conform to the terms of the contract in accordance with the procedure established by law.
The seller is liable for non-conformity of the goods that becomes apparent within two years from the delivery of the goods to the buyer.
If a defect becomes apparent within the first year from delivery of the goods, it is generally presumed that the defect existed at the time of delivery, unless such a presumption is incompatible with the nature of the goods or the defect.
The seller must be notified of a defect no later than two months after the buyer became aware, or should have become aware, of the defect.
Notice of a defect must be sent by email to:
The notice may be submitted in free form but should, where possible, include:
- buyer’s name;
- contact details;
- order number;
- invoice number;
- product name;
- description of the defect or non-conformity.
Where possible, please include photographs of the defect or other evidence demonstrating the defect.
In the case of defective goods, the buyer has the right, under the conditions provided by law, primarily to request repair or replacement of the goods. If repair or replacement is not possible, fails, or other grounds provided by law exist, the buyer may have the right to request a reduction in the purchase price or withdraw from the contract.
The necessary costs associated with repairing or replacing defective goods, including transport and postage costs, shall be borne by the seller in cases provided by law.
In the event of returning or repairing defective goods, the appropriate method of return or handover must be agreed with the seller in advance.
